Medical Legal Cases in Bangalore

Officials from the Rajiv Gandhi University of Health Sciences (RGUHS), Bangalore, contacted the police and said that a lawyer on their behalf had appeared in the Karnataka High Court without permission in several cases related to misconduct reported during the postgraduate medical entrance examination at the Vijayanagar Institute of Medical Sciences (VIMS), Ballari, in 2011. Officials at Tilak Nagar police station, where a case was registered on July 29, said the lawyer had managed to settle 11 cases in favor of the accused. Police registered a complaint against Shivakumar for fraud, which led to missing evidence and identity theft, and said they would hand over the case to Dharwad police. The Supreme Court has ordered the Karnataka Medical Board (KMC) to investigate allegations of medical negligence against a doctor at a private hospital. University officials told police that while reviewing the cases, they recently found that they had lost many cases and learned that Shivakumar S Badwadagu represented the university without permission from their legal department. Badwadagu reportedly appeared before the Dharwad Bank of the Karnataka High Court and claimed to represent RGUHS, the university told police. At the hearing of a petition by H M S Prasad, a Bangalore-based lawyer who had challenged the KMC`s order of 6 June 2013 and rejected his request to prosecute a doctor at Fortis Hospital, Judge A N Venugopala Gowda referred the case back to KMC with instructions to reconsider the case. The applicant`s wife, Vidya Prasad, a private school principal, was admitted to hospital on 10 October 2010. She died the next day. Vidya was admitted with a herniated disc, but was later diagnosed with a heart condition. The Claimant stated that his wife needed surgery for a herniated disc and that when doctors determined she had a heart problem, they should have postponed the operation and the patient was referred to a cardiologist. Citing medical negligence on the part of the physician, the complainant applied to the KMC for instructions for an examination.

At an extraordinary general meeting, it was decided to strongly condemn the recent attacks on Supreme Court Justice H. L. Dattu, Justice of the Supreme Court, who will soon assume the office of Chief Justice of India, and Chief Justice of the Supreme Court of Karnataka, Justice K L Manjunath. In the complaint, Mr R Ravikumar, Registrar (Administration) of the RGUHS, stated that Shivakumar was responsible for handling RGUHS cases from 2010, but was not allowed to appear for the 2011 malpractice cases. The recent Supreme Court ruling awarding Rs 6 crore as compensation in a medical negligence case in Kolkata has raised concerns for several doctors in Bangalore. In January 2011, only a few candidates complained to the Registrar of the RGUHS about allegations of maladministration in the conduct of the competition. Based on the Lokayukta report, the RGUHS annulled the results of 11 applicants and they were not allowed to participate in councils for admission to PG courses at different universities.
