Legal Requirements for Dental Prescriptions

Practitioners who do not have access to an EHR system in their practice or workplace can still issue written prescriptions to patients. There are other circumstances in which a physician with an EHR does not need to prescribe electronically: when the physician and donor are the same unit; if the order cannot be issued as part of the latest implemented version of the PNCDP SCRIPT program; whether an exemption from the DOH has been granted; if it is not practical for a patient to receive a prescribed medication electronically in a timely manner; the drug is the subject of a research protocol; the prescription is for a drug for which the FDA requires that the prescription contain elements that cannot be included in the electronic prescription; the prescription is for a patient who is receiving palliative care or who is a resident of a care facility; or the physician or patient determines that it is in the patient`s best interest to be able to compare drug prices between pharmacies in the area. Bill 831 (2019), Electronic Prescribing, was signed by Governor DeSantis. The effective date is January 1, 2020. The bill includes significant new requirements for prescribing physicians to generate and submit all prescriptions electronically at market authorization renewal or before July 1, 2021, whichever comes first. Beginning Jan. 1, 2022, dentists and other prescribers in California will be required to issue electronic data prescriptions for controlled and non-controlled substances, with a few exceptions. Paper prescriptions will no longer be allowed under state law, CDA previously reported. To prescribe drugs that are controlled substances, a Michigan dentist must obtain a controlled substances license from the Michigan Board of Pharmacy. A dental controlled substance licence allows the dentist to prescribe drugs that are controlled substances in multiple practice settings. However, for the formulation of drugs that are controlled substances, regulatory requirements apply at each office where controlled substances are dispensed. Prescribing physicians can only provide paper prescriptions directly to a patient in situations that are considered exceptions to the electronic data prescribing mandate.

An employee who works in more than one practice may choose to purchase stand-alone prescribing software because, for example, it is not tied to a particular EHR. In addition to the required Michigan Controlled Substances License, a dentist must also be registered with the DEA to prescribe and/or dispense drugs that are controlled substances. Federal controlled substances laws are designed to work with state controlled substances laws. Therefore, the issuance of an AED registration number is contingent on a health care provider`s compliance with all applicable government licensing requirements. An AED registration number can also be summarily suspended or revoked if a Michigan dentist`s license for controlled substances or the license to practice dentistry is suspended or revoked.
