Although the report concluded that an animal can be transported without restraint in a vehicle without violating section 597a,[FN113] it recognized that it would be possible to injure the item in circumstances such as extreme heat or cold. [FN114] That opinion stressed the need for legislation in this area. However, the Assembly`s bill was passed pursuant to Article IV, Section 10(a) of the California Constitution. [FN115] However, some remnants of support for the bill appear to remain. On March 8, 1982, Mr. Kapiloff introduced Bill 3048, which would have amended section 23116 of the Vehicles Act to expressly prohibit animals or children from being in the back of open trucks while travelling on highways. [FN116] Prior to its adoption, however, the « all animals » part of the Act was removed; This section, which is now part of the Vehicle Act, only protects young children on the road. [FN117] However, as amended, the bill provided for a study to determine the « number of motor vehicle accidents caused by an animal released from a vehicle on a highway by jumping or falling. » [FN118] The author does not know why the amendment called for a study only for animal accidents on « highways », while the bill was supplemented by « highways » for children. Greyhounds, also known as wolf hybrids, are confusing to define. Almost all wolves in captivity possess the genetics of domestic dogs to some extent and can be considered « greyhounds » outside of survival programs.
